OFFICIAL REGULATION OF THE "GIFT" CAMPAIGN
SECTION 1. ORGANIZER OF THE PROMOTIONAL CAMPAIGN
1.1. The organizer of the promotional campaign “GIFT” (hereinafter referred to as “Promotional Campaign”) is S.C. RAZADI S.R.L., headquartered in Timișoara, Str. Felix, nr. 25, Jud. Timiș, with its operational point at Cupio – central warehouse, CTPark, TIM4 building, unit F, Calea Lugojului, nr. 148, loc. Ghiroda, postal code 307200, Timiș County, registered in the Trade Register under no. J35/3001/2006, CIF RO19051501.
1.2. The campaign will be conducted in accordance with the provisions of this official regulation (hereinafter referred to as the "Regulation"), which is mandatory for all participants. By participating in this Promotional Campaign, participants agree to comply with all provisions, terms, and conditions of this Regulation and applicable law.
1.3. The Organizer reserves the right to modify and/or supplement this Regulation, as well as the right to suspend, terminate, or interrupt the campaign, provided that participants are notified in advance of any changes to its provisions.
SECTION 2. LEGAL BASIS, NAME, DURATION, AND SCOPE OF THE CAMPAIGN
2.1. This Regulation, as well as any information related to the GIFT campaign, can be obtained free of charge by any applicant by phone at 0372.917.306 or by email at office@cupio.ro.
2.2. The campaign is named “GiFT.”
2.3. The campaign will be held on the e-commerce platform www.cupiocosmetics.com from November 2 to December 31, 2024.
2.4. After the campaign ends, the Organizer has no responsibility and assumes no obligation regarding any circumstances that might suggest the continuation of the campaign.
2.5. The Organizer reserves the right to extend/modify the campaign period during its duration but only after publicly announcing such changes.
SECTION 3. OBJECT OF THE PROMOTIONAL CAMPAIGN
3.1. The object of the Promotional Campaign consists of Cupio, Muah and Pinx products sold at full price on the e-commerce platform www.cupiocosmetics.com between November 2 and December 31, 2024.
SECTION 4. PROMOTIONAL CAMPAIGN MECHANISMS
4.1. All participants in the Campaign who use the code "GIFT" at checkout will benefit from a 15% discount off the full price of products from the Cupio, Muah, and Pinx brands.
4.2. The promotional code "GIFT" must be entered in the shopping cart in the “Do you have a voucher? Add it here” section on the website www.cupiocosmetics.com. The discount will be automatically applied to the total order after entering the code.
4.3. All full-priced products from the Cupio, Muah, and Pinx brands are part of the campaign.
4.4. The campaign is valid only while stocks last. Products that are no longer in stock at the time of assembling the package will be automatically removed from the order without prior notification to the participants.
4.5. A person may purchase multiple products included in this promotion if the products meet the conditions stipulated in this Regulation.
4.6. The cost of transport is not included in the campaign and is calculated automatically based on the value of the order, as found in the "Payment and Delivery" section of the website (https://www.cupiocosmetics.com/payment-and-delivery).
4.7. The package assembly process may take up to 7 working days from the date the order is placed. Participants will receive the ordered products within up to 10 working days from the date the chosen courier company picks up the products, regardless of the selected delivery method.
4.8. Delivery and assembly deadlines may be exceeded due to reasons beyond the Organizer's control. In such situations, the Organizer cannot be held responsible for delays, and the client understands and accepts that such unforeseen circumstances may affect the initially established delivery deadlines.
4.9. The promotional campaign cannot be combined with other offers, promotions, discounts, vouchers, bonus points, loyalty cards, etc. Moreover, orders cannot be combined; each placed order is independent. It is not possible to place multiple orders and subsequently combine them.
4.10. The monetary value of the granted discount is non-refundable.
4.11. If the client chooses to replace the product purchased during the Campaign, the new product replacing it will not benefit from the offer unless it is also part of a Campaign or special offer. For clarity, at the time of replacement, the new product will be subject to the price valid on the replacement date.
4.12. Products purchased during the campaign period can be returned in accordance with the Organizer's standard return policy; however, the refunded amount will reflect the actual price paid by the customer at the time of placing the order.
SECTION 5. ORGANIZER’S LIABILITY
5.1. The Organizer is exempt from any liability for participants' inability to receive campaign-related products due to reasons beyond the Organizer's control.
5.2. The Organizer is absolved of any liability for all damages suffered by participants and/or their legal representatives concerning the purchased products.
5.3. The Organizer cannot be held responsible if, due to force majeure or reasons beyond its control, the campaign dates are altered or the campaign is modified or canceled.
5.4. If, for any reason, this Campaign cannot run as planned due to causes beyond the Organizer's control, fraud, technical issues, or other causes that, in the Organizer's opinion, corrupt or affect the proper administration, security, fairness, integrity, or conduct of the Campaign, the Organizer reserves the right to cancel, terminate, modify, or suspend the Campaign. If the Campaign ends due to force majeure, fraud, or technical difficulties before its official duration, an official announcement will be made at the Campaign location.
5.5. Unjustified claims and complaints proven to be unfounded and abusive form the basis for the Organizer to claim damages.
5.6. By placing an order, participants declare they have read and agree to the terms mentioned in this Campaign Regulation.
5.7. Any disputes between the Organizer and participants regarding any aspect of the Promotion will be resolved amicably, and if this is not possible, the disputes will be settled by competent Romanian courts in Timișoara.
SECTION 6. TERMINATION, SUSPENSION, INTERRUPTION OF THE PROMOTIONAL CAMPAIGN
6.1. The promotional campaign may end before the designated period if the stocks of products included in the campaign are exhausted.
6.2. The Organizer reserves the right to suspend or terminate the promotional campaign at any time, with prior notice to the public, in the following cases: a) In cases of force majeure as defined by the applicable legislation; b) If electronic fraud, hacking, or deceitful activities are detected; c) If, for technical or legal reasons, the regular conduct of the Promotional Campaign cannot be ensured.
6.3. By informing the public of such a decision, the promotional campaign will cease or be suspended by default, and no interested party may request its continuation or claim any compensation.
6.4. The termination or suspension of the promotional campaign for the reasons mentioned above results in the termination of the Organizer's obligations toward participants.
6.5. The Organizer is entitled to take all necessary measures in cases of attempted campaign fraud, abuse, or any other attempts that might affect the campaign's image or the costs involved in organizing and conducting the campaign, including modifying the campaign's procedures.
SECTION 7. DATA PROTECTION
7.1. By participating in this campaign, each participant explicitly and unequivocally agrees to: The collection and processing by the Organizer of information such as the email address participants use to validate their placed orders, as well as other data provided for this purpose. Participants also agree to provide data such as, but not limited to, name, surname, address, phone number, email address, etc., for the purpose of delivering the ordered products included in this campaign as stipulated by this Regulation.
7.2. The Organizer will maintain the confidentiality of participants' personal data and will only use them for the purposes defined in this Regulation.
7.3. Participants have the right to refuse, at any time, freely and without any justification, the processing of their data for direct marketing purposes or its disclosure to third parties for such purposes. Participants also have the right to oppose the processing of their personal data at any time for justified reasons by sending an email to: date.personale@cupio.ro.
7.4. Participants have the right to access information, intervene in their data, oppose its processing, not be subject to individual decisions, and appeal to justice if needed.
SECTION 8. LIMITATION OF LIABILITY
8.1. Using the website www.cupiocosmetics.com is done at the user's own risk. This website is provided "as is," without any representations or guarantees (e.g., availability, accuracy, or completeness), and S.C. RAZADI S.R.L. limits its liability for any of the aforementioned issues.
8.2. Users are solely responsible for obtaining, configuring, and maintaining hardware, software, telecommunication services, and any other equipment or services necessary to use this website.
8.3. By accessing the website, users agree to this Limitation of Liability. If users disagree with the terms in this section, they are asked to cease using the website.
8.4. The internet is not a secure medium, and interruptions, breaches of access, or deliberate and accidental breaches of security and confidentiality of information may occur due to situations beyond the Organizer's control.
8.5. S.C. RAZADI S.R.L. is not liable to users or third parties for damages suffered due to operational errors, changes, or withdrawal of the website.
8.6. Without limiting the above and subject to applicable law, S.C. RAZADI S.R.L. does not guarantee:
Compatibility of the website with the user’s computer or associated software.
Accuracy or completeness of the information on the website.
That any results can be achieved using this website.
That using the website or downloading content will not introduce viruses or other harmful components.
8.7. The Organizer is not responsible for any technical errors that might occur on the platform www.cupiocosmetics.com during the campaign period (December 2-31, 2024).
8.8. By accepting these terms and conditions, users agree to a fair allocation of risks and liability.
SECTION 9. FORCE MAJEURE
9.1. Force majeure is any event that cannot be controlled, remedied, or foreseen, independent of the Organizer's will, which prevents the Organizer from fulfilling its obligations under this Regulation. The Organizer will be exempted from liability if the campaign is hindered or delayed by a force majeure event.
9.2. If force majeure is invoked, the Organizer must notify participants of its occurrence within 5 (five) working days.
SECTION 10. DISPUTES AND FRAUD
10.1. Any complaints regarding the campaign must be submitted in writing to the Organizer's headquarters, via registered mail with acknowledgment of receipt, marked “Promotional Campaign,” within 2 (two) days of the incident. Complaints submitted by phone or beyond this period will not be processed.
10.2. Any disputes between the Organizer and participants will be resolved amicably. If this is not possible, the parties may appeal to the competent courts of Timișoara.
SECTION 11. FINAL PROVISIONS
11.1. The applicable law is Romanian law.
11.2. The provisions of this Regulation are supplemented by the terms and conditions available on the platform www.cupiocosmetics.com, found in the "Terms and Conditions" section.
11.3. The Organizer is entitled to take all necessary measures in cases of fraud attempts, abuse, or any other attempts that might affect the campaign's image or costs.
11.4. If a particular provision of this Regulation is declared null and void, the other provisions remain valid as long as they can produce legal effects even without the invalidated provision.
